Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MailForge platform, including its website, applications, APIs and email services (the "Service"). By creating an account, signing in or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you use the Service on behalf of a company or other legal entity, you confirm that you are authorised to accept these Terms on its behalf, and "you" refers to that entity.

To use the Service you must be able to form a legally binding contract under Nigerian law. You are responsible for the accuracy of the information you provide during registration and for keeping your account credentials, including any two-factor methods, confidential.

Each MailForge workspace has an administrator who manages members, mailboxes, domains and billing. Administrators are responsible for the actions of the members they invite and the content sent from their workspace.

You agree to use the Service only for lawful business communications. You must not, and must not permit others to:

• Send spam, unsolicited bulk email, or content that misleads recipients about its origin;
• Send content that is unlawful, defamatory, harassing, or infringes the intellectual property or privacy rights of others;
• Attempt to gain unauthorised access to other users' accounts, mailboxes, or any part of the Service;
• Interfere with, overload, reverse engineer, or probe the vulnerability of the Service or its infrastructure;
• Resell the Service or create competing accounts to circumvent plan limits.

You may connect your own domain to the Service by adding the DNS records we provide. You remain the owner of your domain and are responsible for keeping its DNS configuration valid. We may reject or pause mail delivery from domains that damage our sending reputation or breach these Terms.

While we use industry-standard practices to maximise deliverability, we cannot guarantee that every message will be delivered, as receiving mail servers apply their own policies.

Paid plans are billed on a recurring basis in the currency shown at checkout. Fees are stated in Naira unless otherwise indicated. Plan fees are generally non-refundable except where required by applicable law.

We may change prices or introduce new plans on reasonable notice. Changes take effect at the start of your next billing cycle after notice. You may cancel a subscription at any time; cancellation stops future renewals and takes effect at the end of the current billing period.

You retain all rights to the emails, templates, contacts and other content you store in the Service ("Content"). You grant us a limited licence to host, transmit, back up and process your Content solely to operate and secure the Service on your behalf.

You are responsible for respecting third-party rights in the Content you send or upload, and for honouring unsubscribe and consent requests from your recipients.

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, or where suspension is necessary to protect the security or reputation of the Service or its users.

You may stop using the Service at any time and may delete your workspace from your settings. On termination we will make your mailbox data available for export for a reasonable period, after which it may be permanently deleted.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, except those that cannot be excluded by law. We do not warrant that the Service will be uninterrupted, timely, or error-free.

To the maximum extent permitted by law, our aggregate liability arising from or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim, and we are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill.

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice before they take effect. Continued use of the Service after the effective date means you accept the updated Terms.

These Terms are governed by the laws of the Federal Republic of Nigeria, and disputes are subject to the exclusive jurisdiction of Nigerian courts. For any questions about these Terms, contact support@mailforge.com.ng.
